An Overview of My Alternative Approach to Family Law Disputes

If you are contemplating filing for divorce or you have already been served with a divorce complaint, you probably have legitimate concerns about whether the emotions that often accompany a marital breakup, such as anger, frustration, anxiety and bitterness, will color your judgment, impact your behavior and result in unintended consequences on your future and that of your children. To the extent you and your partner are willing however you can, in large part, avoid the exaggerated injury that often accompanies the traditional divorce process. In most cases, as you will see, there are healthier alternatives to divorce litigation.

Mediating All Matters Arising Out of Divorce

At the Mediation and Collaborative Law Offices of Rosemarie McElhaney, I counsel couples who seek to settle divorce and family law disputes without the extreme emotional and financial costs of protracted litigation. I can help you resolve all divorce issues, including, but not limited to, child custody, child support, spousal support / alimony, visitation, distribution of assets and liability issues. You and your spouse will receive assistance with:

  • Child custody and Parenting Plans: We will work together to identify and implement parenting plans to help meet the needs of your children while preserving the respective parent-child relationship.
  • Financial issues / Child Support / Spousal Support: In addition to other financial matters, you will be assisted in establishing child support and spousal support agreements that in addition to State guidelines, also considers equitable and 'need based' factors.
  • Assets and Debts Distribution: I will assist you in facilitating a property settlement that carefully structures and distributes all marital assets, including personal and real property, investments, retirement funds, business assets and debts. However since this is also a client driven process, the ultimate agreements remain with you and your spouse. My job is to facilitate the process, facilitate communication and ensure that you understand your rights so that your decisions are well informed.
  • Retirement Accounts and Pensions: All options will be reviewed and facilitited to effect your best informed decision.
  • Post-decree modifications: If your circumstances change once your divorce is final, I can help you work with your ex-spouse to modify existing agreements without court intervention.
